PROBATE WILLS AND ESTATE PLANNING

Our Firm Has Answers To Your Questions About Estate Disputes Estate litigation is a broad term that encompasses several types of legal claims. You may wish to pursue (or require counsel to defend against) allegations of any of the following: Improper trust administration, including failure to make timely distributions to beneficiaries, unwise investment decisions, self-dealing and other forms of breach of a trustee's fiduciary duty Fraud or undue influence in the execution of wills or other estate planning documents that lead to unfair outcomes during the administration of an estate Improper acts by a will executor or personal representative, including payment of excessive fees.
What is Probate?
Simply stated, probate is a public court proceeding in which a court of law supervises the orderly and proper distribution of a decedent’s assets in accordance with the instructions left in the decedent’s will, or, when there is no will, the court imposes the applicable state’s “succession” or intestacy statutes. These so-called “succession” statutes provide for the passage of a decedent’s property and assets to the decedent’s heirs according to the heirs’ relationship to the decedent.
What is a Will Important? Most people should have a will. Wills can distribute your property, name an executor, name guardians for children, forgive debts and more. Having a will also means that you, rather than your state’s laws, decide who gets your property when you die. In most cases, wills are typewritten legal documents that are signed and witnessed, but some states do recognize other types of wills. Most people want to distribute their property differently than the state would distribute it. For example, many people want to leave gifts to friends, neighbors, girlfriends, boyfriends, schools, or charitable organizations – and intestate succession does not allow for any of that. If you want other people or organizations to inherit some of your property, or if you want to decide the proportions of your gifts, a will can make sure your wishes are followed.

Scott Martin with his years of experience is equipped to handle all types of criminal charges, including those that may seem minor. It is important to remember that trying to navigate the criminal justice system on your own puts you at the mercy of prosecutors and judges who are often most concerned with getting a conviction.

OUR PROMISE

No criminal defense lawyer can promise you an acquittal or a favorable plea bargain, making such guarantees is unethical. However, the nature of the legal system is such that prosecuting attorneys often have enormous advantages over defendants. Many of those accused of crimes lack the resources to hire competent legal representation – and because district attorneys possess significant leverage over defendants, many defendants end up negotiating away their rights and signing onto plea bargains that will haunt them for years.
